1. Agreement to Terms

By accessing or using SendWizz ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

2. Description of Service

SendWizz provides a cloud-based WhatsApp API platform, bulk messaging tools, marketing campaigns, and AI auto-responders for businesses. We are an independent service provider and are not affiliated with, authorized, maintained, sponsored, or endorsed by WhatsApp or Meta Platforms Inc.

3. Pricing and Payments

Services are billed on a subscription basis (monthly or annually). You will be billed in advance on a recurring and periodic basis depending on your subscription plan. We use secure third-party payment gateways to process payments. By submitting your payment information, you authorize us to charge all subscription fees incurred through your account to any such payment instruments.

4. Acceptable Use Policy

You are solely responsible for all content sent through our platform. You agree NOT to use SendWizz to:

• Send spam, unsolicited messages, or any form of unauthorized communication.
• Violate any local, state, national, or international laws or regulations.
• Send deceptive, fraudulent, threatening, defamatory, or obscene content.
• Violate WhatsApp's official Commerce Policy or Terms of Service.

Note: We are not responsible if your WhatsApp account gets banned due to non-compliance with WhatsApp's policies. Account bans are at the sole discretion of Meta Platforms Inc.

5. Account Responsibilities

You must provide accurate, complete, and current information when creating an account. You are responsible for safeguarding the password and API keys that you use to access the Service. You agree not to disclose your password to any third party.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of SendWizz and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which our business is registered, without regard to its conflict of law provisions.
